Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website shootfolder.com ("Platform"), operated by Shootfolder.com Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at 111, Block C, East of Kailash, New Delhi — 110065 ("Company", "we", "us", or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.

Shootfolder is a curated marketplace that connects filming professionals ("Crew") with property owners and managers ("Hosts") who list their locations, vehicles, and creative spaces for use in film, television, photography, and other creative productions.

The Platform facilitates discovery, communication, booking, and payment processing between Crew and Hosts. We act solely as a facilitator and are not a party to any agreement between Crew and Hosts.

To use the Platform, you must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872. If you are under 18 years of age, you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

By registering an account, you represent and warrant that all information you provide is accurate, current, and complete, and that you will maintain the accuracy of such information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorised access to or use of your account at security@shootfolder.com.

We shall not be liable for any loss or damage arising from your failure to comply with this obligation. We recommend using a strong, unique password and enabling all available security features.

You may register or log in to the Platform using third-party authentication services, including:

• Google — via Google OAuth 2.0
• Apple — via Sign in with Apple
• Facebook — via Facebook Login
• Microsoft — via Microsoft Identity Platform

When you authenticate via a third-party service, we only access the information strictly necessary for account creation: your name, email address, and profile avatar. We do not request or store passwords from third-party services.

Your use of third-party authentication services is subject to the respective provider's terms of service and privacy policy.

You may delete your account at any time using the Delete Account button in your account settings. Upon requesting deletion:

• Your account will be deactivated within 48 hours of the request.
• Your personal data will be permanently purged within 30 days of deactivation, except where retention is required by law.
• Financial records (invoices, transaction history, GST-related data) will be retained for 6 years as required under the Income Tax Act, 1961, and the Goods and Services Tax Act, 2017.

Any active bookings must be cancelled or completed before account deletion can proceed. Pending payouts will be processed before the account is fully deactivated.

Your use of the Platform is subject to applicable Indian laws, including but not limited to:

• The Information Technology Act, 2000 and the rules thereunder
• The Digital Personal Data Protection Act, 2023 ("DPDP Act")
• The Indian Contract Act, 1872
• The Consumer Protection Act, 2019
• The Goods and Services Tax Act, 2017

Shootfolder acts solely as an intermediary platform connecting Crew and Hosts. We do not own, control, or manage any listed property. We are not responsible for:

• The condition, legality, or suitability of any listed property
• The actions or omissions of Crew or Hosts
• Any personal injury, property damage, or other harm arising from the use of a listing
• Any disputes between Crew and Hosts regarding bookings, payments, or property conditions

All content on the Platform, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Shootfolder.com Private Limited or its content suppliers and is protected by Indian and international copyright laws.

By uploading content to the Platform (including listing photos and descriptions), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content for the purpose of operating and promoting the Platform.

You represent that you own or have the necessary rights to all content you upload and that such content does not infringe on the intellectual property rights of any third party.

All payments on the Platform are processed through Razorpay, a PCI DSS compliant payment gateway. We support the following payment methods:

• UPI (Unified Payments Interface)
• Credit cards and debit cards
• Net banking

Shootfolder does not store your payment card details. All payment information is encrypted and processed directly by Razorpay in accordance with their security standards.

A Platform Service Fee is charged on each booking. This fee is clearly disclosed before payment confirmation and is non-refundable in all cases.

By using the Platform, you agree to:

• Provide accurate and truthful information in your profile and listings
• Comply with all applicable laws and regulations
• Treat other users with respect and professionalism
• Not engage in fraudulent, misleading, or deceptive behaviour
• Not circumvent the Platform to arrange off-platform transactions
• Not upload harmful, offensive, or illegal content
• Not attempt to gain unauthorised access to any part of the Platform

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not make any representations regarding the accuracy, reliability, or completeness of any content on the Platform.

To the maximum extent permitted by applicable law, the total aggregate liability of Shootfolder.com Private Limited, its directors, employees, and agents, arising out of or in connection with your use of the Platform, shall not exceed ₹10,000 (Indian Rupees Ten Thousand).

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

You agree to indemnify, defend, and hold harmless Shootfolder.com Private Limited, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Repeated complaints from other users
• Failure to pay outstanding amounts
• Request by law enforcement or government agencies

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

Before initiating any legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration conducted in Mumbai, India, in accordance with the Arbitration and Conciliation Act, 1996.

By creating an account on the Platform, you consent to receive communications from us, including emails, notifications, and SMS messages related to your account, bookings, and Platform updates. You may opt out of non-essential communications at any time through your account settings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision shall not constitute a waiver of that provision.

The Grievance Officer shall acknowledge complaints within 24 hours and resolve them within 15 days of receipt.

Any feedback, suggestions, ideas, or other information you provide to us regarding the Platform shall be deemed non-confidential and non-proprietary. We shall be free to use such feedback for any purpose without restriction or compensation to you.
